01 Acceptance of these terms
These Terms of Use (the "Terms") form an agreement between you and Azizbek Mizamov, an individual developer trading as PowerApps ("we", "us", "our") governing your use of the Compono application for iOS (the "App").
By downloading, installing or using the App you confirm that you have read, understood and accepted these Terms. If you do not accept them, do not install or use the App.
02 Licence
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
If you obtained the App from the App Store, your licence to use it is the one in Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms add to it and do not replace it; where the two conflict, the Standard EULA governs your licence to use the App.
This is a licence, not a sale. All rights not expressly granted to you are reserved by us.
03 Restrictions
You agree not to:
- Copy, sell, rent, sublicense, lease or otherwise distribute the App
- Reverse engineer, decompile or disassemble the App, except where that restriction is prohibited by applicable law
- Modify the App or create derivative works based on it
- Extract the App’s original content (section 9) in bulk, or republish it or use it to build another product, except as the law allows. The third-party materials in section 10 are not restricted by this: their own licences apply
- Remove or obscure any copyright, trademark or other proprietary notice, including the licence notices that come with the App or appear on this page
- Use the App in a way that breaks any applicable law or regulation
- Use the App, or what you learn in it, to harm, harass or disturb other people
04 Learning, and what the App cannot promise
Compono is a study aid for everyday English. Please read the following as part of these Terms rather than as small print:
- Results vary. We make no promise about how many words you will learn or remember, how quickly, or what you will be able to do with them. The spaced-repetition schedule, the exercises, the memory hooks and every other part of the App are aids, not guarantees
- It is not an exam preparation product. The five levels (A1 to C1) put the course in order, from the most common words to the less common ones. They are not a test, and the App gives no exam score, no CEFR result and no other assessment of your English
- The content may contain mistakes. The explanations in each language, the example sentences, the memory hooks and the “Watch out” notes — some written for the App, some drawn from the third-party sources in section 10 — may contain mistakes, including mistakes of translation, register or usage. Check anything that matters, such as a legal or medical text or an application, against another source. If you find a mistake, please tell us which word
- Reminders are scheduled by iOS and depend on your notification and Focus settings; the App cannot make sure one arrives
- Your progress is stored only on your iPhone, with no account and no sync. If you delete the App, lose the iPhone or set up a new one without restoring a backup, your progress is gone and we cannot recover it
- What a reminder or a lock-screen widget shows can be read by anyone who can see your screen
Important: Compono is a study aid. It does not promise that you will learn any number of words or reach any level, and buying Pro does not change that.
05 Everyday English, including rude words
English as people really use it includes words that some people find rude or offensive. Compono teaches them for that reason:
- The vocabulary includes some everyday swearing and sexual words. They are taught as words you will hear and read, not as encouragement to use them to insult or harass anyone
- They are flagged in the App’s content. Flagged words, and phrases that contain one, never appear in a reminder or on the widget, which anyone looking at your iPhone can read. The meanings shown there are not filtered, so a word that is not flagged can still have a meaning that mentions a sensitive subject. Inside the App, flagged words are part of the course like any other word
- You are responsible for deciding whether the App suits you and anyone else who uses your device. Please keep this in mind if a child uses your iPhone
06 Disclaimer of warranties
The App is provided "as is" and "as available", without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, accurate, compatible with every device or iOS version, or that it will achieve any specific result — including any improvement in your English.
07 Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of data, profit, revenue or goodwill, arising out of or in connection with your use of, or inability to use, the App.
This expressly includes any loss of your progress (section 4), and any loss arising from relying on the App’s content — for example in an exam, a translation, a job application or a legal or medical text — contrary to the guidance in section 4.
Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid for the App in the twelve months before the claim, or USD 10.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities, so parts of the two sections above may not apply to you. In that case, our liability is limited to the smallest extent permitted by law, and nothing in these Terms limits your statutory consumer rights.
08 Free words and Pro
Compono is free to download. The first 1,000 words (levels A1 and A2), with every sense of each, and all of your reviews are free for good. The App offers a single optional in-app purchase, Compono Pro, which opens words 1,001 to 3,000 (levels B1 to C1). Pro is one payment of US$5.99. There is no subscription and no free trial, nothing renews, and you are never charged again.
- The purchase is sold and processed by Apple through your Apple Account. The price is shown in the App, and on the App Store, before you buy. It is shown in your local currency, so it can differ from US$5.99 because of exchange rates and taxes
- It is a non-consumable purchase tied to your Apple Account. You can restore it on your other devices with the Restore purchases action in the App, at no extra cost
- Because it is a one-time purchase, there is no renewal to manage and nothing to cancel
- Words and reviews you have already started stay available to you, as the App says on its plan and paywall screens
- Refunds and billing questions are handled by Apple under its own policies; we cannot issue refunds directly. Request one through reportaproblem.apple.com
- Buying Pro opens more of the course. It does not guarantee any result, and it changes nothing in section 4
09 Intellectual property
The App, its source code, design, user interface, icon, name and logo, and the content written for it — the explanations (glosses) in each language, the example sentences we wrote and the memory hooks — are owned by us and protected by copyright and other laws. This does not apply to the third-party materials in section 10, which stay under their own licences. "Compono" and "PowerApps" are the names we use for this app and its publisher; nothing in these Terms grants you any right to use them without our prior written permission.
Apple, iPhone, iPad, iOS and App Store are trademarks of Apple Inc. We are not affiliated with, endorsed by or sponsored by Apple Inc.
10 Third-party materials and their licences
Compono is built on the work of others. Their materials were selected, adapted and combined for use in the App, as noted below, and they stay under their own licences: nothing in these Terms limits the rights those licences give you in the material itself. This section is where they are credited, with what we changed; the App opens this page from Settings › About › Terms of Use. The licence notices of the software libraries and of the typefaces ship inside the App itself.
The glosses (translations), the memory hooks, the example sentences we wrote and the choice of collocations are our own text (section 9); the definitions are our own wording of Open English WordNet senses.
11 Privacy
Your use of the App is also covered by our Privacy Policy, which explains that the App has no account, no analytics and no server of ours, that everything you do in it stays on your iPhone, and that its only connection is to Apple’s App Store. The Privacy Policy is incorporated into these Terms by reference.
12 Termination
This licence remains in effect until terminated. It ends automatically if you breach any of these Terms, and you may end it at any time by deleting the App from your devices. Sections 4, 6, 7, 9, 10 and 14 survive termination.
We may modify, suspend or discontinue the App, in whole or in part, at any time and without liability to you.
13 Apple-specific terms
These Terms are between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content. You acknowledge that:
- Apple has no obligation to provide any maintenance or support for the App
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation
- Apple is not responsible for addressing any claim relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims
- Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the App infringes intellectual property rights
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you
14 Governing law
These Terms are governed by the laws of the Republic of Uzbekistan, where the publisher is established, without regard to their conflict-of-law rules. Disputes arising from them may be brought before the courts of the Republic of Uzbekistan.
That choice does not take away rights you already have where you live, and is not intended to. If you are a consumer, the mandatory consumer protection rules of your own country continue to apply in full, and you keep the right to bring proceedings in the courts of your country of residence. This is expressly the case in the European Economic Area and the United Kingdom, and applies anywhere else whose law says so.
15 Changes to these terms
We may update these Terms from time to time. The revised version takes effect when it is posted on this page, and the "Last updated" date will change accordingly. Your continued use of the App after that point means you accept the new Terms.
